Summary:Republic Act No. 8293 otherwise known as the Intellectual Property Code of the Philippines was amended by Republic Act. No 10372 which was enacted and signed into law in 2013. The researchers conducted a research regarding one particular provision, section 14 of Republic Act No. 10372. The researchers found that there was a right to bring copyrighted works from abroad stated in section 190.1 and 190.2 of Republic Act No. 8293, however, Section 14 of Republic Act No. 10372 deleted these sections. Since there is no more section stating such right, the researchers claimed that the said section in the amendment of IP code brings confusion on how to interpret the said section whether it removes or allows such rights. The researchers bring out two possible interpretations on Section 14 of the amendment. This research provides a comparative analysis from the perspective of other countries' jurisdiction. Therefore, the research concludes the interpretation of the Section 14 of the amendment and recommends a proposal of new provision in the amendment based on comparative and document analysis.
