Summary: | The Singapore High Court considered the doctrine of economic duress recently in the case Sharon Global Solutions Pte Ltd v L G International (Singapore) Pte Ltd. This note considers the issues surrounding the relevant test for economic duress as well as the factors that should be present before a finding of economic duress can be substantiated. It is argued that the test, in the interest if clarity of analysis, should be a bifurated one, and further, that unconscionable conduct, as a factor of duress, has a crucial role to play. |
