Summary:Earthquake in Nias, 28 March 2005 had devastated most of the infrastructures. Geographically, Nias is isolated area makes difficult in distributing assistances and recovering for casualties. Nias natural disaster is different with others because the location which is isolated and can be reached only through air and sea transportations. Besides that, Nias also lacks of national and international attentions. Many people disappointed that disaster relief is late and the distribution of emergent assistance is inappropriate. This research aims for examining to what extent the TNI role both in normative and actual through Operasi Bhakti post Nias disaster, the constraint faced related to the lately and inappropriate relief and how to increase the performance of TNI in the military operation for humanitarian assistance in order to achieve MOOTW effectiveness in the future.<p>This research uses the qualitative-descriptive method with a case study approach of the TNI MOOTW task within Operasi Bhakti post Nias disaster. Data used are primary data and secondary data. These data are collected by using the technique of interview, observation and documentation. Data are directly collected from the samples of ground, documents and pictures.<p>The research result shows that the TNI MOOTW task is based on the Law no.2/2003, the Law no.34/2004, Tridek TNI Doctrine and the government policy no /2001. These regulations have not ruled to what kind and the extent to which TNI involved within every step of the disaster management that is pre disaster, during disaster and post disaster. Eventhough, actually TNI has implemented the MOOTW task through Operasi Bhakti TNI in Nias. In this case it was conducted by Korem 023/Kawal Samudera which is then categorised as civic mission. This program had recovered Nias community's lives post disaster. The empirical evidences show that it achieved the planned targets. It consisted of the handling of casualties, evacuation, distribution of foods and medicines to isolated are in Nias, the achievement of reconstruction for roads, bridges, school buildings and pray building. However, its implementation had found the constraint that is unfulfilling of OMSP principles within TNI MOOTW task. They are on command and control, integrity, and legislation aspects. These gaps had caused the handling of disaster is late and distribution of emergent assistance is inappropriate.<p>From the research result can be concluded that because of the function and good result owned by this TNI MOOTW task. So it is proposed in every step of management disaster to increase the TNI capacity in disaster relief as the form of humanitarian assistance for MOOTW needs the constitutional effort and institutional as well to embrace policy, strategy, method and implementation which are clear and accountable within every step of disaster management which is suitable with TNI's competence.
