Indonesia is the world's largest archipelagic country, comprising thousands of islands where the sea area of Indonesia is three times the land area. Indonesia's geographical conditions that make Indonesia also known as a maritime country, therefore, Indonesia's large territorial sea up to be a vital aspect in the study that involves the mastery of territory. In addition Indonesia is a multi-ethnic country, there are approximately 300 ethnic and traditional institutions that inhabit Indonesia. Each has a definite ethnic customary law is different also, which is usually also set about mastering the traditional territory. Given Indonesia's vast territorial sea is very extensive and diverse indigenous institutions in Indonesia, there should be identification of Customary Marine Tenure System. In this research, case studies of customary marine tenure systems identification is in the Nolloth, Maluku, because the sea are considered representative for other regions in Indonesia in general. Identifying customary marine tenure systems is done by integrating customary law of Nolloth village with formal legal of Indonesia as regulated in the Act or Regulation. The parameters used in the identification of customary marine tenure systems, among others, covers an area, right holding unit, and the legality and implementation. Customary law governing territorial waters recognized in Indonesia, which refers to the Basic Agrarian Law, and therefore the identification of customary marine tenure systems in Nolloth can be used as a reference in the development of agrarian law in Indonesia.
