Summary: | Since 1967, over forty years, Law. 11 of 1967 regulate provide mining business in Indonesia. Time by time, coupled with the problems that arise, in 2009 the government issued Law No. 4 of 2009 of Mineral and Coal Mining. The problem raised was the comparison between the two mining forms of the laws. The goal was to determine the ratio of business forms and changes between Law no.4 by Act no.11of 1967 The discussion will be done by comparing several parameters associated with the form of a mining business. In Law no. 11 of 1967 recognized some form of business, mining consession and mining works agreements (contract of work (CoW and PKP2B) while in Law no. 4 of 2009 known as a business form a Mining Permit, People's Mining Permit, and Special Mining Permit. The result of the discussion is the forms of exploitation in Law no. 4 of 2009 has a very striking change compared with the form of concession in the Law no. 11 of 1967 including previously traded commodity mining minerals are divided into a, b, c turned into mineral and coal, mining area is the requirement to obtain mining permit, the form of licensing has changed from the KP and contract work into single type of mining permit, new obligations for miners that pay more attention to the environment, improving public welfare, increasing the value added of mining commodities, increasing the local business growth and economic development community. |
