The process of reformation have impacted to the restructuring political and government aspect, one other things was state defence sector. The restructuring of defence institution particularly was done to department of defence (Dod) and headquarters of National Military of Indonesia which are the two main institutions of defence sector. Process of restructuring of those institutions covering : role, function, authority and model relation of those institutions. The restructuring of those institution was directed in creating Dod as a civilian institution in defence sector and headquarters of National Military of Indonesia as an operational institution. Legaly, the restructuring of those institution is regulated by Law number 3 year <br /> <br /> <br /> 2002 on State Defence and Law number 34 year 2004 on Indonesia National Military. Both of law basically were created to uphold the democracy principles in defence management and the using of instrument of defence force, particularly in employing military force. Those principles were actualized with check and balance mechanism asserting that defence affair and military employing could not be put to the only one actor to prevent the misuse of lethal force. Both of law also <br /> <br /> <br /> had formulated not only relation but also separation of political and operational responsibility of state defence. <br /> <br /> <br /> This research findings stated that there are some implementation gaps of provisions that are regulated by the law. The problems of those implementation covering role, authority and model relation of those institutions. From research case finding could be concluded that Dod do not yet fully as civilian institution that play a role in both formulating and deciding all of state policy in defence sector, and headquartes of National Military of Indonesia do not yet fully as operatioanl institution of state defence. The Dod authority in conducting headquarters of national military of Indonesia is being constrained by parrarel and coordination position of those institutions and there is nothing effort to integrate headquarters of National Military of Indonesia into Dod organizational structure. text |
