ABSTRACT <br /> <br /> <br /> In the early nineties, PT Tambang Timah, recently known as PT TIMAH (Persero) Tbk was stated – owned enterprise that its operational area control in islands in Bangka, Belitung of Archipelago Province Bangka Beliyung and Singkep and also Karimun – Kundur, Riau Archipelago was involved in fluctuation by overwhelming of world supply of tin that caused world price of tin decrease drastically at that time. This condition made PT TIMAH was involved in financial difficulty for operational cost. Concerning that condition, PT Timah should take a company deliverance action by doing restructure. One of restructure action was doing assets transforming/resignation that were not relevant to the company main business, so it very important became business capital. <br /> <br /> <br /> Execution of restructure got full endorsement from the government. Many company assets were transformed, so it became business capital toward staffs and/ or to other parties. In this case study discussion, it was still a problem heretofore by the issued letter of Monetary Minister of Indonesia Republic No. S-1218/MK.016/1992 dated October 13th 1992 about Principe approval of abrogation and displacing of fixed assets belong to PT Tambang Timah which were realties and buildings. Afterwards, in analyzing causality of emerge of problem by fishbone diagram to comprehend the problem base that authorization of official home by retirees. Then, it needs to analyze why that letter of Monetary Minister of Indonesia Republic was impropriate to concerned parties. Research methodology used empiric judicative approach and library research and interview. <br /> <br /> <br /> Then, the condition of PT. Timah started to be better, so not all of realties and buildings were transformed to other parties. That condition, especially Timah retirees, felt disappointed and keep weathering to authorize that realties / buildings assets, expecting the company would transform to retirees. On the other hand the company expected retirees had to leave assets authorization which had been resided after 3 (three) months retired as the regulation mentioned in the judicative company documents, such as : Official Home Occupy Authorization Contract (SIMRD) as active staffs period; The different point of view between the company and its retirees must have its solution. <br /> <br /> <br /> The solution offered to solve this case study by causal analyzing that ensue the problem base at internal and external company, that was by doing non litigation action done so far and afterward the company will deliver the letter to its external parties to Indonesia Republic government as share holder and share holder proxy to explain the execution of the letter issued by Monetary Minister of Indonesia Republic year 1992. Furthermore, if by non litigation cannot get solution yet optimally, for maintaining the regulation, so the company mandated to take litigation. <br /> <br /> <br /> Keywords: Contractual Agreement, Realties and Buildings, Judicative, Assets Protection.
