Summary:The territory of a country is the main element in the formation of a country, for this reason the determination of a country is based on applicable international legal norms. The most basic thing in an effort to protect marine areas is to know the extent and boundaries of the country's territory. The territorial boundaries of a country based on Law No. 43 of 2008 article 5 are determined on the basis of bilateral and/or trilateral agreements based on statutory regulations and international law. This affects the manifestation of a country's territory that can be responded to by other countries. One of the problems that arise is maritime territorial border disputes due to unclear national boundaries with the most overlapping territorial statuses according to the version of each country. For this reason, it is necessary to have a baseline as an instrument in determining state boundaries. The problems that arise related to the territorial borders and jurisdiction of the Indonesian state are the technical determination of the archipelagic baselines based on PP. 38 of 2002 in accordance with the baseline guidelines for UNCLOS III (United Nations Convention on the Law of The Sea) and TALOS (Technical Aspect of The United Nations Convention on The Law of The Sea) 1982 or not. It is hoped that with the study conducted by the author, the archipelagic baselines can be used as a reference in determining the configuration of the Indonesian archipelago in accordance with the Indonesian law of the sea.
