| Summary: | The study of characteristic comparison of every customary land tenure is
needed due to the structure differences of the customary land tenure of one cutomary
region to another. Using the result of characteristic comparison of the customary
law, the formulation of the national land policy that based on the customary land
tenure is expected. This will accommodate and represent all of the customary land
tenures that exist in Indonesia.
This study using identification method of land ownership that based on the land
policy that exist in Kasepuhan Ciptagelar and Kampung Naga region. And then the
characteristic comparison of customary land ownership is identified using nine
parameters characteristic system of land ownership that has benn adopted from the
Natioanl Land Policy.
By using these nine parameters to identify the characteristic of land ownership,
there are three types of land ownership that can be identified, Those are Ulayat
rights, Individual rights and land use rights. |
