Summary:In order to fulfilling the right to education and teaching, in addition to implementing the 12-year compulsory education system, the Government also controls the establishment of Indonesian tertiary institutions, especially private universities (PTS). The control aims to maintain the quality and quality of higher education. This research is a legal dogmatics research. The approach method used is the statutory approach and conceptual approach to study the legal problems that occur, namely PTS illegal or without permission. The legal source of this writing comes from laws and regulations, library research on books, journals related to administrative law and licensing law, official portal of the ministry, as well as news portals related to issues discussed in the study. This paper discusses licensing in establishing PTS in the administration of higher education. Licensing is also an instrument of government control in controlling and supervising PTS. Licensing is also intended as a protection for the public to avoid illegal or unlicensed PTS so that it can guarantee the continuity of higher education in Indonesia. PTS which is established without permission from the Ministry of Research, Technology and Higher Education (Kemenristekdikti) may be subjected to administrative sanctions in the form of PTS dissolution. These sanctions can certainly harm students who enjoy higher education there and lecturers who work there so that based on the decision of the Ministry of Research and Technology, a lawsuit can be taken to the State Administrative Court (PTUN).
