| Summary: | The aim of this research is to find out and to explain, first, the conformity
mudharabah contract of PT BPRS Bangun Drajat Warga with Islamic law and
Indonesia contract law (BW). Second, to explain its dispute resolution.
This research is library research that use yuridical normative approach.
The method is to find the truth in the reasearch and to examine mudharabah
contract before Islamic law and Indonesian contract law. The techniques of
collection data are observations of document analysis and interviews. The method
of analysis is desciptive analysis, that describe detailly and systematically the
whole data of mudharabah contract application in PT BPR Syariah Bangun Drajat
Warga.
The hypothesis of this research is, first, mudharabah contract in PT BPR
Syariah Bangun Drajat Warga Yogyakarta is compliance with Islamic law and
Indonesian contract law (BW). Second, the dispute resolution in PT BPR Syariah
Bangun Drajat Warga is by discussion to reach an agreement, if not come to terms
they resolve the dispute by the body of national Syariah arbitration. |
