Summary: | The legal mechanistic human rights taught in majority law school all over the world stand on the conservative legal positivism with subjection between the law and human being. By using legal certainty, the construction reproduces the value of obedience controlling by such norm and mechanism, including sanction to control people staying in order wanted by the ruler. This construction however loses the essence of humanity due to its obsession of legal certainty. Using a critical theorist way of thinking, this study revealing the grand narrative beyond the legal construction and establish a paradigm shift in a humane human rights construction by switching the core of human rights from rights to human. The proposed construction emphasises on discourse within human being. By using ethical commitment, this construction reproduces the value of voluntarism based on human dignity. The practical level of this study traced in Qaryah Thayyibah and its discourse within the members of the community. Although the Islam Jawa colouring the role of leader, elder, and other �roles�, the discourse uses their ethical commitment in a critical education to reproduce their voluntarism value rooted in their moral and religious system reflecting the spirit of Islam Jawa regarding human dignity. |
