This study aims to determine how the freedom of contract principle applied in the form of notarized deed banking loan agreement, and the role of notaries in practice of law counseling to the borrowers when making the default contract on notarized credit agreement. This research is empirical juridical law. The study used primary and secondary data. The primary data obtained through interviews with informants. The Secondary data obtained by studying legal primary, secondary and tertiary materials. The data were analyzed qualitatively. The results of this study indicated that PT.BPR Mitratama Arthabuana Banjarmasin has applied the freedom of contract as one of the principles in the bank credit agreement. The freedom of contract include: the freedom to make or not make an agreement
