| Summary: | A research about the Authority of Public Notary in Making of Cooperation
Certificate in the Province of Yogyakarta especially discussing about the
authority of public notary in making of coopearation certificate, and also the
position of cooperation certificate which does not fulfill the requirement regulated
by Ministry Decree 98/Kep/M. KUKM/IX/2004 about Notary as a Cooperation
Certificate Maker.
The type of this research is a combination of field study and juridiction
research. This research is based on secondary data as the first data, followed by
field collecting, and then analyzing the current ministry decree. This research
subject is notary as the cooperation certificate maker in the Province of
Yogyakarta. The data collecting intrument in this research is open-ended
interview and document assesment related to the problem.
The result of research about The Authority of Public Notary in Making of
Cooperation Certificate in the Province of Yogyakarta are: 1). In running a
position as a maker of cooperation certicate, the notaries have fulfill the
requirement of the decree of Ministry of Cooperation and Small and Average
Corporation of Republic of Indonesian number 98/KEP/M.KUKM/IX/2004 about
Notary as Notaris as Cooperation Certificate Maker. 2). The regulation of
Ministry of Cooperation and Small and Average Corporation Decree number
98/KEP/M.KUKM/IX/2004 about Notary as Notaris as Cooperation Certificate
Maker is help a notary to make cooperation certificate well and properly so the
society either as cooperation costumers or staffs get legal protection, and 3).
Cooperation certificate made of a notary who is not a notary of cooperation
certificate maker is an authentic certificate because it is fulfill the regulation and
requirement of the current law. |
