Summary: | This study aims to identify responsibility and efforts done by early airline
when delay occurred on the flight over passenger having next flight using
different airline and to identify protection for the passenger regulated in carriage
contract between airline and passenger. It is normative juridical study that study
library material that is secondary data and field study that will be analyzed
qualitatively with descriptive method.
The results indicated that airline is commonly not responsible for failure in
flight connection with other airline when flight delay occur. Airline is responsible
only to replace passenger�s loss according to compensation for delay regulated in
Regulation of Transportation Minister No. KM 25/2008 in relation to Regulation
of Transportation Minister No. 77/2011 amended with Regulation of
Transportation Minister No. 92/2011 in early departure station of the passenger.
Efforts done by earlier airline are to communicate with airport officer where the
passenger will transfer to secure next flight schedule, transfer passenger to flight
of their own airline or other airline that still allow the passenger to connect with
next flight, or help to rebook connected-fail flight. UUP regulate responsibility of
carrier in consecutive carriage. As far domestic airlines are not bound in contract
regulating responsibility in consecutive carriage and in general there is standard
clause in ticket stating that �carrier is not responsible for any mismatch schedule
with next flight when using other airline�. Airline and aviation regulation have not
appropriate protection for passenger doing consecutive travel using different
airlines. |
