This research has intention to examine Decree of the Minister of Home Affairs on the appointment of Head of Region and Vice Head of Region West Kotawaringin, Central Kalimantan. The decree was published in order to execute of Constitional Court�s Adjudication of Republic Indonesia Number 45/PHPU.DVIII/ 2010 on dispute of local head general election in West Kotawaringin, Central Kalimantan. The problem of legitimacy of endorsement the appointment of Ujang Iskandar and Bambang Purwanto as Regent and Vice Regent were reviewed in The Administrative Court, on the grounds that the endorsement of the elect-pair of Regent and Vice Regent violates the Law Number 32 of 2004 regarding Regional Governance and violates the general principles of good governance. This research utilized the methodology which was juridical normative method by employing statutory approach, conseptual approach and case approach. These several approach has been used to analyze the Decision of The Administrative Court of Jakarta Number 153/G/2011/PTUN-JKT which declared that the appointment of Regent and Vice Regent West Kotawaringin is unlawful. The result of this study concludes that the legitimation assignment of Regent and Vice Regent Kotawaringin Barat by the Ministry of Home Affairs is lawfull. It is corresponding to consideration of the constitutional and the administrative law.
