Summary:As a law state, Indonesia has consequences that all problems should be regulated by the law, both criminal and civil aspects, as well as on the issue of Mortgage Auction Right. Indonesian society today already know many of the auction, so it do not be surprised if the auction is a way of solving a particular problem which is used by our society nowadays. In Indonesia, the auction is governed by Regulation of the Minister of Finance of the Republic of Indonesia, namely the Minister of Finance Regulation No. 93/Pmk.06/2010 on Instructions of Auction Implementation. In this case the author managed to put together a study in order to accomplish the components of final project. The author chose a theme of Auction Mortgage Application Process through the Office of State Property and Auction Yogyakarta by Law Firm of Garda Utama & Associates. This study uses library research and field work that I did it for two months at the Law Firm of Garda Utama & Associates. During the field work the writer did help resolve the issue of auction of mortgage. In that case, there has been a legal act, the debt receivable agreement, which the debtor has been in default, meaning that the debtor does not pay its debts to creditors. Settlement of the case was finally resolved by way of mortgage auction. Author consulted to the Office of State Property and Auction Yogyakarta to register the application of auction mortgage on a parcel of land which is used as dependents by the debtor at the time.
