Summary:Australia, is the first country to legalized the tobacco control of Plain Packaging. The constitution requiring all tobacco products to be produced in identical package. As a middle country, Australia feel the needs to keep the country health and clean (politically and economically), to do so Australia have to start somewhere, which is health and particularly focused on tobacco control (in this case is the Plain Packaging Bill). Tobacco has been a definite loss in countries all over the world. In Australia, Tobacco is responsible for almost half of death percentage and considered to be a �fixable damage�, therefore the government would do all it takes to try and legalized this bill. In regards of this regulation, Australia has encountered some numerous legal challenges from either countries or tobacco manufacturers. Those parties believed that Australia did not have enough proof that the bill would generates the quality of health and diminishes the number of smokers. Countries has been trying to put down this act of rule of Australia under the agreement of international laws through GATT and Hong Kong treaty. Tobacco manufacturers as well, they tried to put up a fight by suing Australia on charge of violation against property rights. Despite all the accusation, defiance, and legal action against this bill, Australia however, managed to undertake this bill and implemented it. This thesis elaborates the controversy and the interest behind Australia�s motive regarding this bill, whether it is for economic reason, political reason, or simply because of the national trait, or even the three of them. Hence, this thesis consists a broad history, descriptive process behind the legalization of the bill, surveys data, and analysis
