This research analysis the performance of the Islamic Banking system especially a comparison between the pre versus the post spin-off. The comparison of the technical efficiency from both of the types and also comparison of the pre-and-the post of the spin-off process itself are expected to be able to answer the question about how effective the implementation of article 68, Law No.21, 2008 is. Article 68, Law no.21, 2008, obligates all of the Sharia business units to implement the spin-off no later than 2015. In order to measure the technical efficiency, this research used frontier non parametric DEA (data employment analysis) with saving, investment, and operational cost data as an input and loans and net income data as an output. This research is also being supported by qualitative data, such as direct interview with the prominent sources regarding the spin-off corporate actions in Indonesia. In general, the result of this research shows that spin-off is not the only tool to improve the performance of sharia banking inIndonesia as expected by the article article 68, Law No.21, 2008.
