Summary: | Changes of function or boundary designation of forest land are often
followed by a conflict with the local community in Indonesia. It often happens
when, at the outset of the process, the government unilaterally imposes new laws
without establishing any agreement from local residents. In this study, a particular
forest area conflict in Indonesia, the Tanjung Puting National Park (TPNP), is
investigated where agreements were reached. The existence of an agreement
between forest management and communities living in forest land has been
recognized to be a necessity, in order to achieve sustainable forest management.
This research is a deductive-descriptive research. The reasons of choosing
TPNP as the study area were because the existence of negotiation and mediation
in resolving the conflicts between TPNP management and local resident in the
area. Various related documents were studied and interviews with key persons
involved in the conflict resolution process, such as from the government, local
resident and third parties. Furthermore, it was analyzed to trace the process of
conflict resolution, mapping the conflict, and understand the mediation process as
well as to understand the influential factors in each stage of negotiation.
This research shows such a successful negotiation depends on carrying out
the stages in the negotiation process and optimizing the influential factors in it,
such as the various interests, appropriate strategies, possible options, and the
criteria that must be met. This process needs to be backed up by the willingness of
all parties to participate and give their commitment to fulfilling the agreement.
Sometimes, the presence of a mediator/facilitator is very urgent if communication
among conflicting parties dead locked. To success the process, intensive
coordination, adequate dissemination of information, and continual monitoring of
all stages is a must to ensure the final legality of the agreement. |
