Summary: | This research analyzed renegotiation policy established by Indonesian government on
multinational enterprises holding contract of work. In particular sense, the research was intended
to study dynamic of renegotiation process of contract of work between Indonesian government
and Canada multinational company PT Vale Indonesia and to identify why contract of work
renegotiation was protracted. This thesis is library research and field research with interview.
Data was collected using documentary data from books, journal, newspaper, magazine related to
problem studies and data of interview. Collected data is generalized, analyzed qualitatively and
concluded. The results indicated that contract of work renegotiation process between Indonesia
government and PT. Vale since 2009 through Law no 4 of 2009 on Mineral and Coal did not
finished until predetermined time of January 2010. Therefore, Indonesia government added the
renegotiation period and established renegotiation team to solve contract of work renegotiation
with PT. Vale Indonesia. However, until 22 August 2013, PT. Vale Indonesia has not agreed to
renegotiate contract of work with Indonesia government. The cause of protracted contract of
work renegotiation between both parties is caused by two factors. First, international economic
and political conditions are interpreted in some matters such as international-Japan response,
Japan intervention, strong bargaining position of PT. Vale, home country intervention, contract
of work and avoidance by PT. Vale to negotiate. The second factor is domestic economic and
political condition. Inhibiting factor is long term cooperation contract related to nickel export
between Indonesia and Japan and PT. Vale Indonesia, tug of war between central government
and local government (provincial and regency), weak government legitimacy, unstable domestic
economic and political condition, different view and interest in Indonesian renegotiation team,
weak bargaining position of Indonesia government as host country, bad investment climate in
Indonesia mining field, pressure from non government organization and estimation of negative
impact of Mineral and Coal Law implementation. |
