The essential of margin transaction is the purchase of the securities by the customers (buyers) which the part of the price of the securities financed by the securities company by rehypothecating the securities bought on margin. This research performed for the purpose of knowing the character of margin transaction in Indonesian Law of Obligations and knowing whether the margin transaction which are not complied with the provisions of the Regulation of Market supervisory Body Agency and Financial Institution namely. Peraturan Bapepam- LK No.258/BL/2008 against the provision of Article 1320 of Indonesian Civil Law. Data used by this research are primary and secondary data. The data are collected by field research and literature, interview and field study. Based on the research be concluded that the character of margin transaction reviewed by the law of obligations included into No Name Agreement (perjanjian tidak bernama or onbenoemde or innominaat contracten) and Mixed Agreement (Perjanjian Campuran). Further, based on the research, Peraturan Bapepam- LK No.258/BL/2008 does not provide consequences of invalidity of margin transaction. The validity of margin transaction shall reviewed by the provision of Article 1320 of Indonesian Civil Law.
