This research on Medical Malpractice Insurance in the Insurance Business of Indonesia is aimed at finding out the factors influencing the growth of Medical Malpractice Insurance in Indonesia and observing such insurance on the bases of the legalization of the agreement, prevailing general principles and regulations of insurance business in Indonesia, and other related rules of regulation. This research is a normative research employing the literature or secondary data study which is then analyzed qualitatively. However, the primary data are still required through the field research to complete the secondary data. The result of the analysis is further explained using descriptive method by giving the real description on the factors influencing the growth of Medical Malpractice Insurance in Indonesia observed from the legalization of the agreement, prevailing general principles and regulations of insurance business in Indonesia, and other related rules of regulation. Referring to the result of the analysis, it can be concluded that there is an existence of several factors influencing the growth of Medical Malpractice Insurance in Indonesia, namely the large number of claims on medical disputes that force the doctors occasionally indemnify the loss on their own account, the anxiety of the doctors for their profession due to the legal allegation or claim that makes them assume that they need legal advocacy, and the development of the Medical Malpractice Insurance in other countries and for the insurance companies. The Medical Malpractice Insurance is promising enough by looking at the low rate of claim against the insurance product. However, the Medical Malpractice Insurance does not comply with the legalization of the agreement, prevailing general principles and regulations of insurance business in Indonesia, and other related rules of regulation.
