The purposes of this study are to know the pattern of Digital Library fraud in East Kalimantan Province Education Department Fiscal Year 2011 and to know the law enforcement in investigation and prosecution stage of the corruption case number 04/Pid.Tipikor/2013/PN.Smda. This research is a normative-empirical legal research which examines the legislation related investigation and prosecution of corruption cases that applied to the corruption case number 04/Pid.Tipikor/2013/PN.Smda which is a legal fact and then the results of the application will create an understanding of implementation of the provisions of regulations regarding the conduct of the investigation and prosecution of corruption which has been examined whether it has been properly implemented or not. The pattern of Digital Library fraud was Muhammad Adam Darajat, S.T. carry out the work by receiving sub-contract from Kaswiansyah, then Muhammad Adam Darajat together with Kaswiansyah, Hidayatullah, Rifai, and the Audit Committee of Goods, making the work as if it had been completed in September 2011, when the job is completed at the end of December 2011, the software brought was not in accordance with the technical specifications in the Work Letter Agreement Number : 40/SPK/Disdik-Sekret/II/2011 dated August 2, 2011 but the payment has been settled. Law enforcement on the case is attorney investigator and the prosecutor in exercising its authority is not professional, didn�t apply the values of justice contained in the provisions of the Criminal Procedure Code and Special Crimes Technical Case Handling or Standard Operating Procedure, special criminal case handling rules made by Indonesian Attorney General and the values of justice that live in the society.
