| Summary: | The research on the status of the cooperation agreement and business
license, where natural gas processing business license revoked by the Minister of
Energy and Mineral Resources after the Administrative Court decision that break
the cancellation of business license and ordered the Minister of Energy and
Mineral Resources to revoke their decisions on business license of processing the
natural gas. Also examined the factors that influence the status of the cooperation
agreement and business license among other court decision, the result of a court
decision due to the cooperation agreement and dispute resolution post-deprivation
review licensing efforts.
This research is a juridical-empirical legal research by using a
descriptive-qualitative method that researches the factual operation of positive
legal provision on certain legal events and by prioritizing field study in gathering
the primary data. Emphasis is applied on study of laws and legislations to see how
far the law is applied through the field study conducted by interview in a bid to
get clarity on the matter being researched
The results concluded that the satus of the cooperation agreement made by
the parties is valid by law, the same goes for business license is valid by law as it
was issued in accordance with manners and terms provided by law and other
regulation under law. Factor influencing the status of the agreement and business
license is the ruling of state administrative court that may order a revocation of
business license by minister of Energy and Mineral Resources as state
administrative official who issues a decision. Revocation of business license shall
not automatically cancel the cooperation agreement between PT Bina Bangun
Wibawa Mukti and PT Odira Energy Persada. Third-party dispute resolution with
post-extraction licensing efforts undertaken by peaceful means. |
