الملخص:Competition is the only option to establish ecomonic efficiency in a country like Indonesia. However, the mission to maintain competition isnâ��t an easy task for competition authorities, especially in order to enforce competition law. One of the hardest case and to solve which also the most dangerous restriction of competition is cartel. Cartels bring harm to competition and consumers by price ficing, market allocation, and any form of cartels. They are very secretive and entrepreneurs involve in cartels usually hide their agreements so the competition authorities canâ��t prove their wrongdoings. Because of those reasons, competition authorities around the world has adopted Leniency Programme in their jurisdictions. This also happens in Indonesia, The Commission for The Supervision of Business Competition (Komisi Pengawas Persaingan Usaha) has shown that their lack of power in investigation matters has been detained them to solve and enforce competition law, especially in cartel cases. Eventhough leniency programme has shown its successful and effetiveness in desist and deter cartels, KPPU canâ��t adopt leniency program unless Indonesiaâ��s government has revised its competition law. (Undang-Undang No. 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat).
