Summary:This research is aimed to exhaustively determine, assess and analyze the reasons of the continuation of the citizens differentiation based on particular classification in the making of legal heir certificates by the notaries reviewed from the Law Number 40 of 2008 on the abolition of Racial and Ethnic Discrimination, and the inhibiting factors experienced by the notaries in the making of legal heir certificates. This research used empirical juridical approach. The data used were primary and secondary data. The primary data were obtained by interviews and seconda ry data were obtained by conducting literature studies. Interviews were conducted to the respondents, i.e. to notaries meeting the criteria determined in this research and interviews with informants, i.e. the Sub Section Head of Encumbrances and PPAT in the Land Office of Sleman Regency and the Division Head of Human Rights Protection and Fulfillment in the Regional Office of Law and Human Rights of Yogyakarta Province. The data were analyzed by qualitative descriptive. The result of the research shows that there has been no legal unification in legislation on the making of legal heir certificates, thus the provisions which contain discrimination elements in the making of legal heir certificates are still applied to date.
