Summary: | There are some aims of this study. Firstly, examined the disparity of the au pair regulation in Netherland, Germany, and Denmark. Secondly, examined the causative factors of the disparity of the au pair regulation in Netherland, Germany, and Denmark. Thirdly, to make an appropriate recommendation to formulate the au pair regulation from Indonesian national law. This research used normative legal research method that focused on the norms of national, international law, and through the bibliography. There are two approaches method that be used to analyze the collected legal materials in this study, namely statute approach and comparative approach. The result of the research are: First, the disparity of au pair regulation divided au pair into two kind of entity, the special entity as au pair and workers. Second, the main factor that causing the disparity of au pair regulation in Europe due to the absence of commonly regional agreement concerning the legal status of au pair between European Union’s member. Third, as a first measure to formulate the au pair regulation from Indonesian national law, Indonesia could referring to how Philippines government addressing the au pair’s Philippines in Europe that should be customized with the social, economic, and political climate in Indonesia. |
