Persyaratan subyektif penahanan dalam RUU KUHAP masih sama dengan KUHAP. Keberadaan hakim komisaris tidak efektif menyelesaikan permasalahan penahanan karena persyaratan subyektif penahanan yang belum rinci dan terukur. Degradasi moral penegak hukum, khususnya dalam pemeriksaan hakim tunggal dengan putusan bersifat final dan tanpa pengawasan berpotensi menimbulkan penyalahgunaan wewenang. |
