Description
Summary:Purposes of this stud y with a tittle of The Inheritance of Marital Property between Nias and Minangkabau Moslem Society in Padang City are to find out the performance of marriage between Nias and Minangkabau Moslem societies in Padang City, and to find out the inheritance of marital property between them. The study used a sociological legal research for emperical data collection in Padang City. Source of the data were informants, i.e. figures of Minangkabau customary law in Country Customary Council (Kerapatan Adat NagariKAN) or Ninik Mamak Salapan Suku Institution in Padang City, chief of Nias Customary Council in Padang City, chief of village in Nias customary community of Padang City and some figures in Nias customary community of Padang City. Respondents consisted of four married informants and four custodians as inheritors. A literature technique was used to collect secondary data, while an interview guide was used to collect field data. Analysis on the data was done by systematically combining deductive and inductive methods. Result of the study indicates the performance of marriage between Nias and Minangkabau Moslem communities was done based on a consensus between both parties: Nias community customarily used a honest marriage system (sistem perkawinan jujur) and Minangkabau community used a sumando marriage system (sistem perkawinan sumando). It indicates that both parties used their respective customary tradition and was practically in accordance with Islamic sharia precepts and the existing regulations. The performance of marriage based on the different customary legal systems shows that there occured assimilation and acculturation in both parties life. The inheritance of marital property for parties with the Nias customary marriage tradition was done by applying an individual system, and that for parties with Minangkabau one was done by applying a collective system. The parental inheritance of marital property was done for inheritee both boy and girl.
