Ph.D. ETD Research on the legal protection of consumers in buying or selling flats (apartments prima1 case study on the developer PT. Primaland Internusa Development in Jakarta), was conducted in order to determine whether consumers' rights are protected in the sale and purchase of a prime apartment flats based on consumer protection legislation, any barriers that occur in the implementation of legal protection for consumers in buying or selling flats apartments Prima 1 and efforts to what can be taken in case of violation of consumer rights. This study using a normative juridical approach. This approach is used to know some of the rules in force in consumer protection home ownership flats. Besides the normative approach, in this study also uses an empirical approach. Empirical approach used to obtain an explanation and to know things related to the implementation of legal protection of consumers in buying or selling flats. The data in this study use a secondary data and primary data. Sekuder data obtained through the study of literature and primary data obtained from the field. Data were analyzed using qualitative methods. The results showed that the implementation of legal protection of consumers in buying or selling flats Apartments Prima 1 with developer PT. Primaland Internusa Development there are some violations committed by the developer, among other things: first, the consumers have not gotten their rights to comfort, security and safety in consuming goods and/or services, secondly, the consumers have less rights to advocacy, protection, and efforts to settle disputes in a proper consumer protection, third-party consumers do not get their right to compensation, compensation and/or replacement, if the goods and/or services received is not in accordance with the agreement or not as it should. Obstacles in the implementation of legal protection of consumers in buying or selling an apartment flats Prima 1 with the developer PT. Primaland Internusa Development comes from the consumers themselves, the developers, and government officials. Efforts that can be taken by consumers in case of infringement of their rights can be done outside the court and in the courts is through consultation/negotiation, arbitration, and through the court of claims in default.
