Summary: | Indonesia is the signing country of General Agreement on Trade in Services
(GATS). In schedule of specific commitments , Indonesia has committed in the field
of business activities Financing Company. This action absolutely bringing
implication concerning business activities Financing company in Indonesia. The
purpose of this writing is to know about the implications of Indonesia's commitments
in GATS concerning the business activities of the Financing Company and the
implication of GATS to the growth of Financing Company in Indonesia.
This research is a applied law research namely normative study. Research
conducted is normative law that is spatially descriptive analytic. Analysis of data
performed on this research is analysis of data that uses methodology qualitative,
referring to procedure research intended to give a description deep about the
problems that assessed.
Implication GATS concerning business activities Financing Company
analyzed in three aspects. First, application of general commitment of Indonesia as
signer of GATS implied to any action central government the regional government,
regional government even the act of institution non governmental taken in relation to
trade services will be influenced by GATS�s rule, Indonesia must meet the conditions
of transparency and Most Favored Nation as well as provisions on Domestic
Regulation are the implemention in the rules that govern the company's business
finance activities. Second, application of the MFN exception not affect anything
concerning Financing Company business activities in Indonesia. Third, application of
schedule of specific commitments has the biggest impact on business activities of the
Financing Company. It relates to the abolition of barriers in the Market Access and
the enactment of National Treatment. On the second study, it turns out that the
implication of GATS to the development of business activities of the Financing
Company not very significant. Hence, we must try to optimize Indonesia's
participation in the WTO and GATS generally in particular to improve the economy
of this country. |
