The type of negligence would include wrong diagnosis, wrong treatment and failure in carrying out treatment that resulted in patients disability or death.The objective of this study is (i) Why medical practitioners often committed misconduct in the practice in Indonesia and Malaysia (ii) What factors are driving up medical misconduct in Indonesia and Malaysia.This study was a qualitative in nature and using a comparative method. The research was conducted by employing various methods of data collection, including the study of literature, documentation study, observation, interviews and questionnaires. Data were analyzed using content analysis method and t test.In the case of the occurrence of factors misconduct, from 5 indicators there are 3 significant differences between Indonesia and Malaysia, namely: (a) In the case of negligent medical practitioner or less careful in performing its functions, (b) lack of skills of medical practitioners, and (c) lack of time medical practitioners in performing the task.
