This paper presents the legal issues attached in deciding whether the Senate should ratify the Japan-Philippines Economic Partnership Agreement (JPEPA) or not. It tries to answer this issue by presenting three corollary issues, whether or not the JPEPA provisions constitute a violation of the local environmental laws, the Basel Convention (in which both the Philippines and Japan are signatories thereof), and the Philippines Constitution. It also tackles the advantages and disadvantages connected in passing (or not passing) the said executive agreement and the legal consequences associated in this decision.
