Summary: | Detention of the underprivileged patients by hospitals due to their inability to pay their medical expenses gave rise to the enactment of Republic Act 9439, entitled An Act Prohibiting the Detention of Patients in Hospitals and Medical Clinics on Grounds of Non-payment of Hospital Bills or Medical Expenses. Republic Act 9439 was passed to respond to the prevailing conflict of interest between public and private hospitals and medical clinics and the patients. The right to property of hospitals is weighed alongside the rights of patients to life, liberty and health. Through research and analysis, the writers of this paper will answer this challenge on both parties and suggest ways on whose interest should be given preference. |
