The provision in the Constitution which was primarily created to guarantee that the process of selecting members of the judiciary truly was an innovation, however, the researchers find that ambiguities present in the process caused the issues that transpired. Considering the questions raised, the researchers however focused on the Philippine process of appointing Justices in the Supreme Court and relating it to the United States appointment process.
