Summary: | Nowadays, Intellectual Property is becoming more significant in this age of Globalization. Companies and businesses are capitalizing on their internal strengths and these strengths are usually intellectual property rights. These intellectual properties are patents, trade secrets, copyrights, industrial designs, among others. The WTO has established treaties that protect these rights, one of which is the Agreement Trade-Related Aspects Intellectual Property Rights of TRIPs Agreement. These treaties are based on the assumption that intellectual property protection would always induce economic development which would be beneficial to counties.
China presents a case contrary of the common notion which is also a purpose of the TRIPS Agreement. China, even if it does not strictly protect IP rights, has been rapidly growing since the opening of its economy to foreign investment. This study would now discuss what made China become developed even if it did not strictly protect IP rights. This study would also discuss if China really really did or did not protect IP rights.
