| Summary: | Diplomatic negotiations concerning trade policy are known to be confidential in nature. At present, the Philippines is exerting extensive efforts in free trade to attain economic development. The confidential nature of these diplomatic negotiations is hindering the private sector from properly performing its role in national economy.
This study advocates the right of the private sector to be informed with regard to trade negotiations. This is important because without sufficient information, the private sector is bound to be deprived of its Constitutional right to participate in economic development. The researchers aim to expose the inefficiency of the current legal framework used in dealing examined AKBAYAN vs. Aquino to determine its suitability with the diplomatic secrets privilege.
The emergence of regional trade agreements compels the Philippines to be more dependent on free trade en route to its goal of economic development. With the prevalence of issues surrounding trade policy development, the Philippines will be hindered from realizing this goal. |
