No ticket, no problem?: A study on the legality of ticket scalping under the Philippine jurisdiction

Ticket scalping in the Philippines happens during anticipated events whether it be during the sale of tickets or during the event itself, whether it be in public or online. In Quezon City, they have a city ordinance considering ticket scalping unlawful. But should not one consider that such act is a valid contract of sale, and an exercise of ones ownership over a thing? The study aims to find out the legality of ticket scalping under the Philippine jurisdiction. There is a need to look into the Quezon City ordinance no. SP-493, S-97, if it is in conflict with the Civil Code with regards to ticket scalping. Knowing that ticket scalping is a valid contract of sale, and an exercise of ones ownership over a thing. There is also a need to look into the enactment of the Quezon City ordinance with regards to an invalid exercise of police power. Knowing that ticket scalping under the city ordinance considers unlawful both the buying and selling of tickets outside the admission booth. The Quezon City ordinance is in fact in conflict with the Civil Code because ticket scalping is a valid contract of sale, and an exercise of ones ownership over a thing. The city ordinance is also an invalid exercise of polic power because it lacks lawful means, since it is a burden to those who validly agree and given their consent to another regarding a ticket sale. The thesis aims to repeal the Quezon City ordinance SP-493, S-97, or at least amend and to provide a proper definition of ticket scalping, and to also consider the act as a cybercrime.
