This study involves the discussion of a question of law regarding a specific provision of Republic Act 8049 or the Anti-Hazing law and the Convention on the Rights of the Child. It aims to analyze whether or not the exclusion of punishment for psychological harm, despite defining it in Section 1 as an act of hazing, is violative of the constitutional mandate and CRC. And whether or not Animo Pep Squad's and Harlequin Theater Guild's initiation act to make their applicants or new members wear mismatch clothes or do embarrassing acts like shouting around Henry Sy Grounds is considered an act of hazing. The study is limited within the three corollary issues presented. It is also within the Philippine setting only. The researchers conducted interviews with stakeholders and used the historical method as their research methodology. The goal of the study is to answer whether or not Section 4 paragraph 2, of Republic Act 8049 or the Anti Hazing Law is in consonance with Section 11 of the State Policy to value human rights and dignity and the Convention on the Rights of a Child, and whether or not the initiation acts of the Animo Pep Squad and Harlequin Theater Guild is considered hazing in accordance with the student handbook.;"By comparing points whether they are violative or not, the result of the investigation will find that Section 4 paragraph 2 of the R.A. 8049 is not in consonance with the constitutional mandate and the CRC due to the fact that psychological harm is still considered as a violation of human rights and human dignity, especially if the victim is a child. And because the current laws enacted by the government specifically for the provisions of the CRC is said to be too general that is still lacking in terms of giving specific provisions for the protection of the child's rights.
