Description
Summary:The advancement of the technology came with innovations in the basic necessities of mankind. One of these necessities is transportation. The inconvenience associated with transportation has led to the establishment of Uber, which was deemed as the pioneer in application-based transportation services provider. Uber introduced transportation service provision by using peer to peer business model. The drivers for Uber are individuals who perform services for Uber using their own private car. These drivers were immediately compared to taxi drivers which had sparked a debate on whether Uber drivers are employees or independent contractors. Due to the technicality of the business set up of Uber, there have been a number of arguments from both sides. This study discerns the consistency of section 13.1 of Uber's Partner-Driver Agreement Services, which defines the Uber drivers as an independent contractor, with Philippine laws and jurisprudence.
