Summary: | The case involves the decision to terminate or not to terminate, the services of a faculty member. The principal of St. Agatha Academy had rejected the letter of reapplication from one faculty member. The faculty concerned appealed and submitted a reconsideration letter. The parish priest of the town had even sought her to reconsider the case. Sister Principal is faced with this dilemma. The school administration found a solution based on the school policy. Specific provisions of the Contract of Service and Termination of Appointment are stated as follows: 1. The probationary period is three years. Probationary teachers are paid on a 10-month basis. Teachers on probation who do not renew their application or do not receive any reappointment for teaching for the coming school year are given ten months pay. 2. Contracts of teachers on probation are automatically terminated at the end of the school year. Pertinent provisions in the Dismissal Policies and Procedures are: 1. Appointment of faculty member on probation expires at the end of the academic year, unless renewed for the second academic year of probation or for permanent appointment. 2. Appointment of faculty member on permanent status may be terminated on the following: a. gross inefficiency (teaching incompetence, frequent absences, tardiness in class, frequent failure to meet reasonable deadlines for the submission of grades and reports, manifest non-cooperation in official activities or functions such as faculty meetings, committee meetings, etc. |
