To deal with the problem, it is recommended that an antitrust law of general application by enacted into law. The paper makes a study of the antitrust laws being enforced in the United States, which pioneered antitrust legislation in the 1890s. Further, it also makes a study and comparison of antitrust laws passed and implemented in the Asean countries to enhance competition, protect consumer welfare, and to encourage the entry of investments. It also makes a survey of all the antitrust offenses. Finally, the research recommends the passing of an antitrust law in the Philippines. It reviews Senate Bill No. 3197 which is a proposed bill pending legislation in Senate that deals with antitrust and competition. The paper makes a critic and evaluation of the Senate Bill and makes recommendations for its reform and improvement so as to effectively deal with and penalize antitrust practices in our country.
