Summary:The problem sought to be addressed in the study is the lack of recognition by the state that an effective investigation of death is a human right as well as the lack of legal remedy for failure to conduct effective investigation. In this study, the author seeks to prove that an effective investigation of death is a human right. The study would show that the effective investigation of suspicious death is a part of the right to life, which is a human right. The concept of human rights will be discussed to demonstrate the importance of the designation of a right as a human right. International laws and domestic laws would be studied in relation to effective investigation of suspicious death as part of the right to life. Cases from the Philippine Supreme Court and other international human rights courts would be also studied to show the standards of an effective investigation of suspicious death. A bill would be proposed to provide a legal remedy to make investigating officers accountable for failure to conduct an effective investigation and to give reparation to the family of the victim of suspicious death.
