Description
Summary:Product liability has been an area of notable significance during the second half of the twnetieth century. It assumed its present importance following the introduction of "strict liability" in tort in various overseas countries. Strict liability is a relatively new concept when compared to the traditional principles of negligence and breach of contractual warranty. It enables liability to be imputed upon any entity in the chain of distribution irrespective of conduct or the lack of contractual relationship with the defendent. Recent developments in this field have caused considerable sensation and controversy with regard to the basis upon which judgements are passed and amounts awarded.
