Despite the ISM Code being a mandatory regulation, there is still the presence of substandard shipping and this report will look into the driving force of non-compliance and conversely, also look at why other ship operators choose to exceed compliance. With the help of literature reviews, interviews and surveys, this report seeks the views from the various ship operators and their practical views about the ISM Code. Using these results, this report will then discuss about the costs and benefits of non-compliance and find the balance between the two. This discussion serves to explain the rationale behind non-compliance and put forward the risks due to such non-compliance. Finally, in the conclusion, the rationale of the ship operator’s decision with regards to level of compliance will be wrapped up by weighing the costs and benefits and with the help of the interviews with industry players, further support the conclusion made at the end of the report.
