When we first took on the topic of “On Compensation for Personal Injury Cases” for our Applied Research Project, we were appalled by the vast numbers of technical terms used. Hence, for a better understanding by a layperson, we summarised the major concepts and principles so as to provide a simpler explanation of the topic. The main aim of this project is to provide an insight into how damages in courts are determined in a personal injury case. Many a times, the living plaintiff of an accident or the estate of the deceased do not know what constitutes the amount they receive as compensation. In the event of such a case arising, one of their major concern will be the monetary loss they suffered. Therefore, the Loss of Future Eamings element, being the principle component in the compensation amounts, will be the focus of this project.
