Financial Disincentives and Restraints on Trade
At common law, restrictive covenants are viewed with disfavour; the are prima facie unenforceable unless shown to be reasonable for the protection of legitimate interests. This is because public policy dictates that a person should be free to make a living through the use of his skill or labour.
