To help her balance, the performing artist continually moves the rod, changing the angle of the rod to maintain a constant – her balance in space. If she were to hold the rod in a fixed position, what would happen? She would fall off. In other words, the variation of the rod has the function of maintaining the deeper continuity which enables the artist to make it to the other end, alive. In this essay, the tightrope walker offers a metaphor for dispute resolution systems. In order for a dispute resolution system to survive, it needs to be agile and adapt to changing circumstances; to evolve – just like a tightrope walker. 2020-10-01T07:00:00Z text application/pdf https://ink.library.smu.edu.sg/sol_research/3299 info:doi/10.2139/ssrn.3742561 https://ink.library.smu.edu.sg/context/sol_research/article/5257/viewcontent/SSRN_id3742561.pdf http://creativecommons.org/licenses/by-nc-nd/4.0/ Research Collection Yong Pung How School Of Law eng Institutional Knowledge at Singapore Management University mediation COVID-19 technology dispute resolution Dispute Resolution and Arbitration |
