<b>Abstract</b> : <p align=\"justify\"> <br /> Construction projects are highly influenced by uncertainty factors occurred during construction phase. This situation may lead parties into dispute. Negotiation process was the most attractive alternative dispute resolution in finding resolution in the conflict occur among the parties. Lack of information in determining compensation range may cause difficulties for the negotiator in determining the suitable compensation for the parties. <br /> <br /> The objective of this research is to develop a model which can be used to made an agreement in determining compensation asked by contractor. This model was developed based on the \'Ask-Take\" and \"Offer-Give\" approach (Sparks, 1995). By using this approach, the model simulates the negotiation process in order to find the utility functions of contractor and owner. Some graphical representations will be drawn to present a visual information about position of each parties and the area of possible agreement can be made. <br /> <br /> Data collecting was done to get some informations about compensation asked by contractors and could be given by owners. In fact, limitation collected data barrier the development process of this model. Therefore, the Monte Carlo\'.s method was used in randomizing utility value of contractors and owners. Data manipulating was done by differentiating the probability function of compensation value in order to get information about some behavioral aspects of contractors and owner which is: risk aversion, risk neutral and risk preference. Based on the utility function and graphical representations, an agreement can be made by using some decision criteria : maximizing profit and the equilibrium point. <br /> <br /> Through the using of the model, negotiation process with different behavior of the contractors and owner will result in both a different area of possible agreement can he made and compensation value will he given to or by the parties.
